The present application has been filed seeking to condone the delay of 295 days in filing the written statement of the defendants.
2. In the affidavit filed in support of the said Judges Summons, it had been stated that there were elaborate discussions with respect to the issues in the suit and the Executive Committee Members had to be informed about the nature of the suit and after consideration, the counsel had actually been changed and thereafter the written statements had been filed.
3. On 14.12.2023, my learned Predecessor had directed each one of the defendants to pay costs of Rs.5,000/- to Adyar Cancer Institute, Chennai on or before 10.01.2024 and had further stated that on compliance of that particular condition, the application to condone the delay in filing the written statement would be accepted by the Court. https://www.mhc.tn.gov.in/judis

4. The learned counsel now affirms that the condition had been complied with, within the time stipulated. Necessary proof had also been forwarded to this Court.
5. In view of that particular fact, the delay is condoned and the written statements of the first to fourth respondents are taken on record.
