PRAYER: Writ Petition filed under Article 226 of the Constitution of India, seeking to issue a Writ of Mandamus seeking direction towards the Respondents herein to withdraw the Look-Out Circular issued as against the Petitioner herein Connection with FIR registered in Crime No.05 of 2024 on the file of the 2nd Respondent herein considering the Petitioners Representation dated 22.09.2025.

ORDER
This Writ Petition has been filed for a direction, directing the respondents to withdraw the Look Out Circular issued as against the petitioner in pursuant to the registration of F.I.R. in Crime No.5 of 2024. 2.It is the contention of the learned counsel for the petitioner that the petitioner is not an accused in Crime No.5 of 2024, pending on the file of the 2nd respondent, registered for the offences punishable under Section 66(D) of the I.T.Act, 2000 r/w Section 409 and 420 of IPC. Alleging that the accused cheated the general public to the tune of Rs.1,75,00,000/- and out of the crime proceeds, a sum of Rs.15 lakhs was transferred to the petitioner's account. Therefore, the investigation is still pending in Crime No.5 of 2024. 3.The learned Government Advocate (Crl. Side) submitted that though
the 2nd respondent issued several summons to the petitioner to appear for enquiry, the petitioner did not appear before the 2nd respondent for investigation. Further, the petitioner also visited abroad and as such in order to complete the investigation, the 2nd respondent issued Look Out Circular. Now the petitioner returned to India, and even then the petitioner failed to cooperate with the investigation pending in Crime No.5 of 2024, on the file of the 2nd respondent. 4.At this juncture, the learned counsel for the petitioner submits that he has already sent a written representation to the 2nd respondent stating that he is again willing to cooperate with the investigation. 5.In view of the above, the petitioner is directed to appear before the 2nd respondent for investigation purpose in crime No.5 of 2024.
The 2nd respondent is directed to complete the investigation and file a final report within a period of eight (8) weeks from the date of receipt of a copy of this order in Crime No.5 of 2024. After completion of the investigation, the 2nd respondent shall consider whether the pendency of the Look Out Circular is necessary or not. 6.With the above direction, this Writ Petition stands disposed of. Consequently, the connected WPMP No.118 of 2026 is closed. No costs.
