Prayer : Writ Petition has been filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the 1st to 3rd respondents to grant permission to conduct cultural program of "Nattupura Issai Kacherry" in regarding with the celebration of "Uzhavar Thirunal Pandigai" i.e., Pongal Festival on 16.01.2023 at 6 pm to 11 pm in the
petitioner's village namely, "Eechur Village" which is located at Gingee Division, Villupuram District by considering and pass orders within the time frame as may be fixed by this Hon'ble Court on the basis of the petitioner's representation dated 16.12.2022. ORDER
The Writ Petition has been filed to direct the 1st to 3rd respondents to grant permission to conduct cultural program of "Nattupura Issai Kacherry" in regarding with the celebration of "Uzhavar Thirunal Pandigai" i.e., Pongal Festival on 16.01.2023 between 6 pm to 11 pm in the petitioner's village namely, "Eechur Village" which is located at Gingee Division, Villupuram District by considering and pass orders within the time frame as may be fixed by this Hon'ble Court on the basis of the petitioner's representation dated 16.12.2022.
2. The learned counsel appearing for the petitioner submitted that in order to conduct cultural program of "Nattupura Issai Kacherry" on
16.01.2023 between 6 pm to 11 pm, in regarding with the celebration of "Uzhavar Thirunal Pandigai" i.e., Pongal Festival in the petitioner's village namely, "Eechur Village" which is located at Gingee Division, Villupuram District, the petitioner has sent a representation, dated 16.12.2022 to the respondent. But, the same has not been considered so far. Hence, the present writ petition has been filed.
3. The learned Government Advocate (crl.side), appearing for the respondent submitted that the second respondent police has received the representation of the petitioner and the same is pending for consideration.
4. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (crl.side) appearing for the respondents.
5. It is brought to the notice of this Court that the Director General of Police, Tamil Nadu, Chennai, had issued a circular memorandum in Rc.007301/Genl.I(1)/2019, dated 09.04.2019, along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of
applications seeking permission for conducting cultural programme. Therefore, in view of the detailed circular and guidelines issued by the Director General of Police, the second respondent police is hereby directed to consider the representation of the petitioner, dated 16.12.2022 and pass suitable orders based on the above said circular.
6. With the above direction, this Writ Petition is disposed of. No costs.
