J U D G M E N T
(Judgment of the Court was delivered by S.M.SUBRAMANIAM, J.) Writ Appeal has been instituted challenging the writ order dated 31.07.2017 in W.P.No.8029 of 2010.
2. State preferred intra-Court appeal mainly on the ground that conversion of Vocational Instructor post of Weaving cannot be permitted as per G.O.Ms.No.39, School Education (D1) Department, dated 21.03.2003, wherein, conversion of the posts of Tailoring and Music are permitted. The fact remains that the respondent school initially appointed Mr.E.Dhanasekar as Weaving teacher, who died on 18.08.2003. After his death, no Weaving teacher was appointed and the Writ Petition came to be instituted in the year 2010, after a lapse of about 7 years seeking conversion of post of Weaving as Music teacher. The Government rejected the application stating that such conversion of post cannot be granted as per the Government policy.
3. Pertinently the post of Weaving teacher became vacant from 19.08.2003 onwards. The Writ Petition was filed in the year 2010. The learned Government Advocate would submit that the post of Weaving teacher is abolished throughout the State. However, the post of Music teacher is available. Under these circumstances, the respondent is at liberty to submit a fresh application for sanction of post, if the school is otherwise eligible under 2/4
the Government policy. In the event of filing any such application, the same may be considered in accordance with law.
4. Accordingly, this Writ Appeal is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. (S.M.S., J.)
