This petition has been filed to condone the delay of 880 days in filing the Civil Miscellaneous Appeal.
2. Inspite of the order of notice, notice was returned 'unclaimed' by the respondent. As such, the service through court is completed. There is no appearance on behalf of the respondent.
3. Being satisfied with the reasons stated in the affidavit filed in support of the pettion, we are inclined to condone the delay, however, on payment of cost of Rs.2000/- (Rupees Two Thousand only) by the petitioner to the Madras High Court Legal Aid Services Authority, Chennai, within a period of one week from today. If the cost is paid on or before 19.06.2023 and the affidavit of service is filed, this Petition stands allowed and the registry is directed to number the main appeal. If the cost is not paid and the affidavit of service is not filed on or before 19.06.2023, this C.M.P. stands dismissed without any reference to this Court. (J.N.B.,J.)
