ORDER

The petitioner seeks modification of the condition in para No.4 in Crl.O.P. No.26371 of 2023 dated 21.11.2023, imposed by the Hon'ble Justice C.V. Karthikeyan, which reads as follows:

"4.

Taking that one factor into consideration, this Court is inclined to grant anticipatory bail to the petitioner, on condition that the petitioner is directed to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.629 of 2023 before the Judicial Magistrate, Sankarapuram. The learned Judicial Magistrate may transfer the said amount to any fixed deposit interest earning account and pass final orders after conclusion of the trial. If the petitioner is acquitted, the amount with interest may be handed back to the petitioner and if the petitioner is convicted, the amount with interest may be handed over to the defacto complainant." https://www.mhc.tn.gov.in/judis 1/2

The reading of the above shows that this Court had taken into consideration the facts and circumstances of the case and directed the petitioner to deposit a sum of Rs.1,00,000/- to the credit of Crime No.629 of 2023 and granted anticipatory bail to the petitioner.

In view of the above, this Court is not inclined to modify the condition in para No.4 imposed on the petitioner in Crl.O.P. No.26371 of 2023 dated 21.11.2023.

Accordingly, this criminal miscellaneous petition is dismissed. 20.03.2025 stn To The Inspector of Police, Kuniamuthur Police Station, Coimbatore City, Crime No.331 of 2024.
