ORDER
(DELIVERED BY P.N.PRAKASH, J.) The present petition has been filed by the petitioner for a direction to the respondent to produce the detenue, S.Suganya, aged 21 years, daughter of the petitioner, before this Court and set her at liberty.
2. Heard the learned counsel appearing for the petitioner, the learned Addl. Public Prosecutor appearing for respondents 1 and 2 and Mr.Tippu Sultan, learned counsel appearing for respondents 3 to 5.
3. It is the case of the petitioner that his daughter, Suganya, was married to one Naresh, but her matrimonial life ran https://hcservices.ecourts.gov.in/hcservices/
into rough weather on account of which the detenue came to her parental home and, thereafter, she was working in a vessel shop where she developed intimacy with the third respondent, Rajesh. It is alleged by the petitioner that the detenue went missing on 22.9.14 in connection with which a case in Crime No.1622/2014 for 'Woman Missing' has been registered by J-8, Neelankarai Police Station and investigation is in progress.
4. Today a status report is filed by the learned Addl. Public Prosecutor, wherein the steps taken by the respondent police to secure the girl are narrated. The status report as also the averments in the petition show that the detenue is aged 21 years which shows that she is a major. The status report further reveals that the detenue had gone on her own volition with the third respondent.
5. In the above circumstances, this Court is of the considered opinion that there is no case of illegal detention made out by the petitioner warranting issuance of a writ of habeas corpus. Accordingly, this petition is closed with a direction to the respondent police to proceed with the investigation in Crime No.1622/2014 and keep the petitioner informed of any development/breakthrough in the case. sd/- Assistant Registrar(Cs-III) /TRUE COPY/ Sub-Assistant Registrar GLN To
