Petition under Article 226 of the Constitution of India praying for issue of a Writ of Certiorarified Mandamus to call for the records relating to the proceedings of the 2nd and 3rd respondents in Na.Ka.1825/2020/dvs dated 03.07.2020 and Na.Ka.3234/2019/dvs dated 21.07.2020 and to quash the same and consequently direct the 5th respondent herein to allow the petitioner duty in 5th respondent society.

O R D E R

This writ petition has been filed challenging the charge memo dated 03.07.2020 issued by the 2nd respondent and the surcharge proceedings dated 21.07.2020 issued by the 3rd respondent to the petitioner. When the writ petition is taken up, it is brought to the notice of this Court by the learned Standing Counsel for respondents 4 and 5 that subsequent to filing of this writ petition, final orders have been passed by the Disciplinary Authority dismissing the petitioner from service. He would further submit that since the petitioner has been dismissed from service subsequent to the filing of this writ petition, he will have to necessarily challenge the dismissal order in the manner known to him under law. Recording the submission made by the learned Standing Counsel for respondents 4 & 5 that final orders have been passed by the Disciplinary Authority dismissing the petitioner from service, the writ petition is disposed of by granting liberty to the petitioner to challenge the 3\6

dismissal order in the manner known to him under law. No costs. Connected W.M.P.s are closed.
