ORDER

The prayer sought for herein is for a writ of mandamus directing the 1st respondent to consider the representations of the petitioner dated 07.08.2020 and 26.08.2020 to survey the land by issuing proper notice to the adjacent land owners i.e., the 4th and 5th respondents herein within a stipulated period of time.

2. In respect of the property at S.No.27 at Athanavur Village, Yelagirimalai, Tirupathur Taluk and District, the petitioner has made an application to the first and second respondents to survey the land to identify the four boundaries and in this regard, application has been submitted on 07.08.2020 with necessary fee. Therefore, in order to consider the same, the present writ petition has been filed.

3. Heard Ms.Radhika Boopathi, learned counsel appearing for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the respondents 1 to 3. 2/4

4. In view of the order going to be passed in this writ petition, notice to the private respondents is hereby dispensed with.

5. Learned Special Government Pleader appearing for the official respondents would submit that the said application submitted by the petitioner would be considered after giving notice to both the petitioner as well as the private respondents and will do the needful within a time frame that may be stipulated by this Court.

5. Considering the said submission made by the learned Special Government Pleader appearing for the respondents 1 to 3, this Court is inclined to dispose of this writ petition with the following orders: That there shall be a direction to the first and second respondents to consider the application of the petitioner dated 07.08.2020 after giving notice to both the petitioner as well as the private respondents and do the needful within a period of eight(8) weeks from the date of receipt of a copy of this order. 3/4
