Memo is filed regarding compliance of the order dated 12.08.2021 and the same is recorded. A.No.2727 of 2021 is filed to condone the delay of 123 days in filing written statement. According to the applicant, the suit summon was served on him on 17.09.2020, but he could not file written statement within 30 days. There is a delay of 93 days in filing the written statement. The delay was caused due to disruption of normal life under Covid-19 pandemic situation. Further, 120th day fell on 14.01.2021 during the Pongal recess and therefore, immediately after re-opening of Court written statement was filed on 18.01.2021. Hence, the applicant pray for condonation of delay and to receive the written statement.

2. Considering the reasons and explanation given by the applicant, the delay is condoned on payment of costs of Rs.5,000/- (Rupees Five Thousand only) to the plaintiff, on or before 15.09.2021. Accordingly, the A.No.2727 of 2021 is allowed.
