Crl.M.P.No.2763 of 2024 in Crl.O.P.No.5473 of 2023 A.D.JAGADISH CHANDIRA, J.

This petition has been filed seeking to extend the time granted by this Court in Crl.O.P.No.5473 of 2023 dated 21.07.2023 to file a final report in Crime No.155 of 2021.

2. In support of the above prayer, Mr.S.Ramu, Inspector of Police, Vigilance and Anti-Corruption Unit, Puducherry, has filed the affidavit before this Court.

3. It is seen that the case in Crime No.155 of 2021 was registered for the offence of fabrication of documents and land grabbing and this Court, on 21.07.2023, while dismissing the petition in Crl.O.P.No.5473 of 2023 filed by the first respondent herein for quashing the First Information Report, had directed the petitioner herein/Inspector of Police, V & AC, Puducherry, to complete the investigation in Crime No.155 of 2021 within a period of three months and file a 1/4

final report. However, now the petitioner has filed this present petition seeking further time to file the final report.

Learned Public Prosecutor (Puducherry) submitted that the investigation in this case is not completed for want of original documents/records, which have to be collected from the office of the Sub-Registrar, Thirunallar, Karaikal as well as the Login ID details from the Registration Department have to be collected. He further submitted that further, the sanction for prosecution against the accused, then Sub-Registrar, Jayakumar, is also to be obtained from the competent Authority. Therefore, he sought for extension of time.

5. Heard the learned Public Prosecutor (Puducherry) appearing for the petitioner and perused the Affidavit filed by the petitioner.

Taking into consideration the facts and the submissions that the original documents have to be collected from the office of the Sub-Registrar, Thirunallar, Karaikal and other details also have to be collected from the Registration Department, Puducherry and also considering that sanction for prosecution has to be obtained from the competent Authority, this Court feels it 2/4

appropriate to extend the time to file the final report by three months.

7. Accordingly, this Criminal Miscellaneous Petition stands ordered and the time granted by this Court in Crl.O.P.No.5473 of 2023 dated 21.07.2023 to file the final report is extended by three months from today. 26.02.2024 ham 3/4
