Petition praying that in the circumstances stated therein the High Court will be pleased to set aside the conviction and sentence and waive the fine amount passed against the Appellants on 22/01/2009 in C.C.NO.31 of 1999 on the file of the Principal Special Judge for C.B.I. Cases, Chennai.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.T.MURUGANANTHAM [LEGAL AID COUNSEL FOR APPELLANT-2], and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- The learned counsel appearing for the appellant would submit that he has been instructed to argue on the question of sentence. However, he would further submit that he will get appropriate affidavit from the appellant who is now incarcerated at Central Prison, Puzhal. He seeks time to get the affidavit attested by the prison authorities.

The Superintendent, Central Prison is directed to furnish the details with regard to the number of days, the appellant M.Vincent Xavier, son of Michael, convicted in C.C.No.31 of 1999 by the learned Principal Special Judge for C.B.I. Cases at Chennai, dated 22.01.2009 has been in custody during remand and also after conviction.
