O R D E R

This petition is filed seeking to transfer the investigation in Crime No.178 of 2015 which was registered by the Hosur Traffic investigation wing for the offence under section 279, 304 (A) of IPC.

The learned Additional Public Prosecutor submits that the accused could not be identified in this case. It is further submitted that it is a case of hit and run. After investigation, the case was closed as undetected. RCS notice was filed before the Court and the Judicial Magistrate, Hosur had sent the notice to the defacto complainant / petitioner herein. Thereafter, the petitioner / defacto complainant had appeared before the Judicial Magistrate on 18.08.2017 and stated he has no objection for the case to be closed and also given a written letter to that effect.

In view of the same, nothing survives for adjudication and the same stands dismissed.
