This petition is filed to restore the above Criminal Appeal No.229 of 2008 which was dismissed for default on 27.10.2018.

2. It is seen that the appeal has been dismissed for default. As per Section 374(2) of Cr.P.C., it is mandatory that the appellant should be heard in this case. Admittedly the appellant has not been heard. In view of the same, this Criminal Miscellaneous Petition is ordered.

3. Post this Criminal Appeal on 31.03.2022.
