ORDER

The petitioners, apprehend arrest at the hands of the respondent police for alleged offences punishable under Sections 296(b), 351(2) and 303(2) of BNS in Crime No.425 of 2025, on the file of the respondent police, seek anticipatory bail.

2. The allegation against the petitioners is that, due to a money dispute, the petitioners, joining hands with other accused, took away 8 cows belonging to the de facto complainant. Hence the case has been registered.

3. The learned counsel for the petitioners submitted that the petitioners herein are ranked as A2 to A5 and they have been falsely implicated in this case. Further, he submitted that they have neither assisted nor been involved in the alleged offence. It is also submitted that the petitioners are ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate appearing for the respondent police reiterated the prosecution case and submitted that there are totally 8 accused were involved in this case and that A1 and A6 to A8 have been arrested and are under custody. Further, she submitted that from the petitioners herein only 2

cows have been recovered and the remaining 6 cows are yet to be recovered and that the investigation is also pending. Hence, she vehemently opposed the grant of anticipatory bail to the petitioners.

5. Considering the nature of the allegation, and the fact that the remaining 6 cows are yet to be recovered and that the petitioners have also actively participated in assisting the accused A1 in stealing the cows, this Court is not inclined to grant anticipatory bail to the petitioners.
