ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for alleged offences punishable under Sections 316(5), 336(3) and 318(4) of BNS, in Crime No.500 of 2025, on the file of the respondent police, seeks anticipatory bail.

The allegation against the petitioner is that, while working as a Branch Manager of Avanti Finance Private Limited, the petitioner has collected a sum of Rs.33,47,969/- from various persons, such as collection agency directly from the parties and also siphoned off the money, thereby cheated a sum of Rs.33,47,969/- of the de facto complainant's finance institutions. Hence the case has been registered.

The learned counsel for the petitioner submitted that the petitioner had collected the amounts and the same has been remitted into the bank account of the finance institution, but it has not been properly accounted for. Without proper verification of the accounts, the petitioner herein has been arrayed as an accused for misappropriation of money. Further, he submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned counsel for the intervenor also appeared and opposed the grant of anticipatory bail to the petitioner, on the ground that the statements recorded from the other staff members of the said finance institution to the effect that the money collected by them was handed over to the petitioner. Further, he submitted that the documents show that the petitioner has received the said amount. Apart from that, some of the money was also received through his wife's Bank account and the petitioner's Bank account. Hence, he opposed for grant of anticipatory bail to the petitioner.

The learned Government Advocate appearing for the respondent police while opposing the grant of anticipatory bail reiterated the prosecution case and submitted that various transactions were made by the petitioner herein through different persons and sum of Rs.33,47,969/- was misappropriated, for which, the petitioner had also issued bogus NOCs to various persons. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

Considering the nature of the allegations, the fact that so far, no amount has been recovered from the petitioner; that the investigation is still pending and nature of the amount involved is at Rs.33,47,969/- and the statements recorded from the staff working under the said finance institution, which also implicate the petitioner herein, hence, this Court is not inclined to

grant anticipatory bail to the petitioner.
