Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus directing the second respondent to dispose of the conciliation proceedings initiated under 2-K of the Industrial Dispute Act, 1947 in Na.Ka.No.Aa/883/2025 and Na.Ka.No.Aa/315/2025 or refer the matter to the Labour Court within a time to be fixed by this Court. ORDER

The writ petition is filed for a direction to the second respondent to dispose of the conciliation proceedings initiated vide Na.Ka.No.Aa/883/2025 and Na.Ka.No.Aa/315/2025.

2.The writ petition is disposed of at the admission stage without notice to the first respondent management. This Court is not expressing any opinion on the merits of the dispute or otherwise.

3. The case of the petitioner is that as against the lockout declared, the petitioner has raised a dispute and the conciliation is now pending before the second respondent. It is stated that the dispute was originally raised by the petitioner on 14.03.2025 itself.

4. Therefore, since the matter has been pending for a long time, the second respondent shall complete the conciliation proceedings. Upon receipt of the web copy of the order, without waiting for the certified copy of the order, the second respondent shall complete the conciliation proceedings by issuing notice to the petitioner and the management to appear on the earliest date. The date of hearing can also be informed through telephone, email and in person.

Immediately, the conciliation dates can be fixed and the conciliation can also be conducted on a day-to-day basis and in any event, the conciliation proceedings shall be completed within a period of three weeks from the date of receipt of the web copy of the order, without waiting for the certified copy of the order.
