ORDER : The Court Made the following order :- The petitioners who were arrested and remanded to judicial custody on 26.12.2021 for the offences under Sections 294(b), 506(2), 273 of IPC r/w. 7, 20(1), COTPA Act 2003 and u/s. 58, 59 Food Safety and Standards Act 2006, in Crime No.600 of 2021 on the file of the respondent police seek bail.

2. The case of the prosecution is that on 26.12.2021, when the respondent police officials were engaged in regular checking of vehicle, they found the petitioners transporting banned Tobacco products weighing 6300 Kgs. which is worth about Rs.42,31,300/- in a vehicle bearing registration No. TN-22-DF-4856. Hence, the complaint.

3. The learned Counsel for the petitioners submitted that the petitioners are poor Cooli labourers and they have not committed any offence as alleged by the prosecution and the have been falsely implicated in this case and that they have been suffering incarceration for about 24 days from 26.12.2021. Hence, he seek for grant of bail to the petitioners.

4. The learned Additional Public Prosecutor raised strong objection stating that the petitioners along with 4 others transported banned Tobacco products weighing 6300 Kgs worth about more than Rs.42,00,000/- and it needs a detailed investigation.

5. On seeing the nature of offence and the quantity of alleged tobacco products, the case needs a detailed investigation. Hence, this Court is not inclined to grant bail to the petitioners.
