PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondent police 1 and 2 to provide adequate police protection to the petitioners life and property situated at No.1/14, Mariyamman Koil Street, Kalampattu Post, Via Latheri, Katpadi Taluk, Vellore District - 632 202 and pass such further or other orders as it may deem fit and proper in the circumstances of the case and thus render justice. 1/4

ORDER

This criminal original petition has been filed for a direction to the 1st and 2nd respondents to provide police protection to the life and property of the petitioners based on the complaint given by the petitioners on 12.09.2023. 2.The grievance of the petitioners is that the property belongs to them and that their son who is the 3rd respondent and the daughter-in-law who is the 4th respondent is causing threat and committing cruelty against the petitioners on a daily basis. The learned counsel submitted that the petitioners who are octogenarians cannot go to any Court at this point of time and they require protection. The learned counsel further submitted that the complaint was given to the Revenue Divisional Officer was not acted up on. 3.The learned Additional Public Prosecutor on instructions submitted that the 2nd respondent conducted the enquiry in C.S.R.No.170 of 2023 and the 2/4

complaint was closed on 30.09.2023 on the ground that dispute was between the father and the son.

4.In the considered view of this Court, the petitioners are octogenarians and they will not be in a position to approach any Civil Court at such an advanced age. If the 3rd respondent and his wife are causing threat to the petitioners and forcing the petitioners to convey their property to him, the 2nd respondent is directed to take immediate action against the 3rd and 4th respondents, if they continue to exert pressure on the petitioner. 5.The criminal original petition is disposed of with the above directions. 22.01.2024 Index: Yes/No Speaking order/Non-speaking Order ssr To 1.The Superintendent of Police, 3/4
