JUDGMENT
This Civil Miscellaneous Second Appeal is filed against the Judgment and Decree dated 30.04.2004 made in A.S.No.13 of 2004 on the file of the District Court, Nagapattinam modifying the Judgment and Decree dated 31.10.2003 made in H.M.O.P.No.266 of 2000 on the file of Sub Court, Tiruvarur.
2. Today, when the matter is taken up for hearing, the learned Counsel for the appellant seeks permission of this Court to withdraw the Civil miscellaneous second appeal, since the matter has been settled out of the Court and he has also made an endorsement to that effect.
