For Petitioner:

ORDER
Asserting that the petitioner is the owner of 19 acres and 36 cents in new S.No.28 on the basis of sale deed bearing document no.1245/2002 dated 27.05.2002, the petitioner has approached this Court upon finding that the encumbrance certificate relating to S.No.28 reflects document nos.910/1983, 4475/2019 and 2102/2020. After submitting representations seeking deletion of entries relating to such conveyances, the petitioner instituted this writ petition.
2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for all the respondents. He submits that the request for effacement of entries in the encumbrance certificate cannot be entertained unless the
executants and claimants under the documents referred to by the petitioner come forward to execute an appropriate rectification deed.
3. The contention of learned Special Government Pleader is liable to be accepted. Nonetheless, in order to ascertain whether the assertion of the petitioner that S.No.28 is unrelated to the documents mentioned in paragraph 4 of the affidavit, it is just and appropriate that an inquiry be held by issuing notice to parties concerned.
4. Therefore, this writ petition is disposed of by directing the registering officer/third respondent to issue notice to the executants and claimants of document nos.910/1983, 4475/2019 and 2102/2020 and dispose of the petitioner's request after providing a reasonable opportunity to the said persons and to the petitioner. This process shall be concluded within thirty days from the date of receipt of a copy of this order. There will be no order as to costs. 03-02-2026 Index : Yes/No Internet:Yes/No kj
