Application No.5977 of 2019 in C.S.No.715 of 2015 Krishnan Ramasamy, J., This Application has been filed by the applicant/third defendant to condone the delay of 301 days in filing the application to set aside the exparte order dated 01.02.2018 passed by this Court in C.S.No.715 of 2015.
2. In the affidavit filed in support of this application, it is stated that since the applicant was working in Dubai, he could not arrange for vakalatnamas, power of attorneys, notarized memorandums etc. in time to file before this Court. It is further stated that due to personal as well as professional difficulties faced by him in Dubai, he was not able to engage the counsel to contest the suit and hence there was a delay in filing the application to set aside the exparte decree dated 01.02.2018.
3. Heard both sides. The learned counsel appearing for the respondents would submit that this application may be allowed subject to terms.
4. Having been satisfied with the reasons stated in the affidavit filed in support of this application and also considering the submissions made by the learned counsel for the applicant, this application is http://www.judis.nic.in
KRISHNAN RAMASAMY, J arr allowed subject to payment of a cost of Rs.3,000/-(Rupees Three Thousand only) to the respondents on or before 30.08.2019.
