ORDER

This Criminal Original Petition is filed to set aside the order dated 29.10.2025 passed in Crl.M.P.No.6 of 2025 in Crl.A.No.939 of 2025 by the learned XXI Additional Sessions Judge, Allikulam, Chennai. 2.

The learned counsel appearing for the petitioner submitted that the petitioner is a house-wife and with great difficulty, she was able to arrange the funds only now. The petitioner has earlier applied for extension of time to comply with the conditional order dated 01.08.2025 and despite granting of extension of time, the petitioner was unable to comply with the condition due to her poor financial status. She further submitted that the appellate Court has issued non-bailable warrant of arrest and she is facing threat of arrest. Now, as

the petitioner is ready with the amount, an opportunity may be given to her to deposit 15% of the cheque amount to the credit of S.T.C.No.530 of 2023 before trial Court as per order dated 01.08.2025 passed in M.P.No.1 of 2025 in C.A.No.939 of 2025 and the appellate Court may be directed to recall the warrant.

Heard the learned counsel for the petitioner and the learned counsel for the respondent.

Taking into consideration the submission made by the learned counsel for the petitioner, the petitioner is directed to deposit 15% of the cheque amount to the credit of S.T.C.No.530 of 2023 before trial Court within a period of one week from the date of receipt of a copy of this order and on the next working day, the petitioner shall surrender before the appellate Court and file an application seeking recall of the warrant. On filing such application, the appellate Court shall consider the same and pass orders thereon. 5.

This Criminal Original Petition stands disposed of with the above direction.
