This Civil Miscellaneous Petition has been filed to permit the petitioner to withdraw the final 50% amount, deposited as per the orders in CMA No.238 of 2011 dated 21.06.2017 lying in the credit of MCOP No.1030 of 2008 on the file of the Motor Accident Claims Tribunal, Chief Judicial Magistrate, Dharmapuri.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.
3. This Court vide order dated 21.06.2017 has permitted the petitioner/claimant to withdraw 50% of the award amount and directed to deposit balance 50% of the award amount in a fixed deposit account for a period of five (5) years.
4. The petitioner submits that the five (5) years period expires on 21.06.2022. He is aged about 68 years and is suffering from diabetes and blood pressure and therefore, he seeks permission of this Court to withdraw the balance 50% of the award amount as it is required for his treatment. https://www.mhc.tn.gov.in/judis Page No:1/2

5. Considering the reasons stated by the petitioner, the petitioner is permitted to withdraw the balance 50% of the award amount without resorting to formal procedure.
