O R D E R
This writ petition has been filed by the petitioner to call for the records pertaining to the order passed by the first respondent in Na.Ka.C2/27/2023 dated 19.12.2024 and to quash the same.
2. The case of the petitioner is that he is the eldest son of the third respondent and he is a Local Cable Operator. The third respondent and his wife (petitioner's mother) was in care and custody of the petitioner, since they were not in terms with the other son viz., Thirunavukarasu, who is also a Cable Operator, a competitor in business for the petitioner. Now, the third respondent and his wife have developed a cordial relationship with the aforesaid Thirunavukarasu, one of the brothers' of the petitioner. Thereafter, at the instigation of Thirunavukarasu, the third respondent filed a complaint under Senior Citizen Act, claiming right over the customership of the Cable TV connection, run by the petitioner, leading to an order dated 08.07.2023, directing the petitioner to share profits from 127 cable connections as monthly maintenance. Though the petitioner has sent the maintenance Page No.2 of 7
amount, the third respondent refused, instead demanding the actual cable connections and allegedly attempted to transfer them to Thirunavukarasu. The Petitioner's attempts to modify the order dated 08.07.2023 and appeal dated 19.12.2024 were rejected, culminating in the present grievance.

Learned counsel for the petitioner submitted that this Court vide its order dated 10.01.2025 directed the petitioner to deposit a sum of Rs.2,07,900/- to a separate Bank Account and produce the proof thereof. Pursuant to which, the petitioner has drawn demand draft in favour of the third respondent for a sum of Rs.1,50,000/- dated 20.02.2025, Bank of India, Jayankondacholapuram branch bearing D.D.No.978752 and sought time to deposit the remaining sum of 57,900/- to the credit of third respondent.

Learned counsel for the petitioner would further submit that this Court by its order dated 26.03.2025 directed to get instruction from the petitioner in regard to the payment of sum of Rs.10,000/- as monthly maintenance to the third respondent. Pursuant to which, the petitioner has sent a written instruction, stating that he is ready and willing to pay a sum of Rs.5,000/- to his father and Rs.3,000/- to his mother, as monthly maintenance Page No.3 of 7
and the same was produced before this Court.
5. Learned counsel for the petitioner further submitted that the petitioner is paying a sum of Rs.6,300/- to the third respondent as monthly maintenance, till march 2025 without any default.
6. Heard the learned counsel on either side and perused the materials available on record.
7. In the written instruction of the petitioner, he stated that he is ready and willing to pay a sum of Rs.5,000/- to his father and Rs.3,000/- to his mother, as monthly maintenance. However, this Court taking into consideration of petitioner's mother's health condition, directs the petitioner to pay a sum of Rs.6,000/- to his mother and Rs.3,000/- to his father, as monthly maintenance.
8. The aforesaid maintenance amount shall be paid by the petitioner to his father and mother, on or before 10th of every month, without any default. Page No.4 of 7
In case of any default on the part of the petitioner, the third respondent is at liberty to approach the second respondent to take appropriate action against the petitioner.
9. If any complaint has been raised by the third respondent against the petitioner, the second respondent is directed to give effect to his order dated 08.07.2023, in accordance with law.
10. This writ petition is disposed of with the aforesaid observation and directions. No costs. Consequently, connected miscellaneous petition is also closed.
