ORDER
The petitioner, who was arrested and remanded to judicial custody on 03.12.2025 for the alleged offence punishable under Section 376, 406, 323,
506(i) IPC and section 296(b), 115(2) of BNS in Crime No.56 of 2025 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner developed relationship with victim in the year 2022 and somehow he convinced the victim girl and acquired her photograph and thereafter, started harassing the victim girl and demanded her various sexual favour and also threatened her to pay the money and accordingly collected money to the extent of Rs.5 lakhs. Even thereafter, the petitioner continuously harassed the victim; unable to bear the same, she has lodged the complaint and the petitioner was arrested.

Learned counsel appearing for the petitioner submitted that the major allegation is that the petitioner has suppressed his earlier marriage and had sexual relationship with the victim in this case and further there are money transactions taken place between both sides and he has not cheated the victim girl and it is only a consensual relationship and he is ready to cooperate with the investigation. Hence, he prayed to grant bail to the petitioner.

Learned counsel for the intervener submitted that there are grave allegations that the petitioner has continuously harassed the victim girl and had sexual relationship and there are other allegations that recording of videos of the victim is with petitioner and sofar, no videos have also been recovered and the
investigation is pending. Hence, he opposed to grant bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner was arrested on 03.12.2025 and the investigation is almost concluded and the phone of the petitioner has also been recovered and sent for forensic examination and the forensic report is also awaited. Hence, he opposed to grant bail to the petitioner.
6. Considering the nature of the allegation and the fact that the petitioner is in custody from 03.12.2025, and there is no previous cases reported and the major part of the investigation is almost concluded, this Court is inclined to grant bail to the petitioner with certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Additional Mahila Court, Coimbatore District, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of four weeks. [c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
