Mr.B.Thanikachalam, learned counsel appearing for the respondents 3 and 4 would submit that the counsel for the appellant P.Kannan is no more, and other counsel Mr.S.L.Rajesh had left the office even earlier. He would also submit that the dispute is between the brother and sister and after a preliminary decree is passed and before passing a final decree, the matter has been settled and the property of the subject matter is sold away to third parties. Hence, the appeal is dismissed as settled out of Court. No costs. Consequently, the connected miscellaneous petition is closed.
