C.M.P.Nos.1846, 1849 and 1852 of 2023 in S.A.No.1245 of 2006 P.T.ASHA, J., These petitions have been filed by the petitioners to condone the delay of 98 days in filing the petition to set aside the abatement caused due to the death of the 1st appellant viz., Elumalai; to set aside the abatement caused due to the death of the 1st appellant and to bring on record the legal heirs of the deceased 1st appellant, as appellants 4 to 6 in the above second appeal.
2. Heard the learned counsel appearing for the petitioners and the learned counsel for respondent-2.

Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and the petitions are allowed.
