ORDER

1. Heard.

2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of O.P.No.2628 of 2019 from the file of the IV Additional Principal Family Court, Chennai, and transfer of the same to the file of the Family Court, Vellore.

3. The marriage between the petitioner and the respondent was solemnized on 23.08.2017 at Thiruthani Subramani Swamy Temple a per Hindu rites and customs.

4. The petitioner is stated to be residing at Vellore. The Original Petition in O.P.No.2628 of 2019 has been filed by the respondent/husband seeking divorce. It is also stated that a maintenance proceeding in F.C.M.C.No.42 of 2019 filed by the petitioner is pending at Family Court at Vellore.

5. Learned counsel for the respondent would submit that the petitioner/wife is presently residing at Chennai, though her permanent place is at Vellore.

6. Having regard to the residence of the petitioner at Vellore, the pendency of the maintenance proceedings at Vellore, and considering the convenience of the wife, this Court is of the view that the transfer sought deserves to be ordered.

7. Accordingly, Tr.C.M.P.No.35 of 2026 is allowed. O.P.No.2628 of 2019 on the file of the IV Additional Principal Family Court, Chennai is

withdrawn and transferred to the Family Court Vellore. The learned Judge, IV Additional Principal Family Court, Chennai, is directed to transmit the records in O.P.No.2628 of 2019 to the learned Judge, Family Court, Vellore, within three weeks from the date of receipt of copy of this order and the Family Court, Vellore shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order.
