Helper II/C&W/Loco/Vol dated 11.10.2010 issued by the second respondent, quash the same as illegal to the extent the petitioner is reengaged as a Substitute Helper and granted temporary status with

effect from 19.09.2010 and consequently direct the respondents to reinstate the petitioner with continuity of service from 31.12.97 and grant him all consequential benefits including temporary status, permanency, re-fixation of pay scale, arrears of salary, seniority, with payment of 50% backwages and all other attendant benefits with exemplary costs. ORDER

This Writ Petition has been filed challenging the order passed by the first respondent bearing No.ENGG/32/2010 dated 22.03.2010 read with the order bearing No.Sa.Je.Thi/J/P269/V/Sub. Helper II/C&W/Loco/Vol dated 11.10.2010 issued by the second respondent and consequently direct the respondents to reinstate the petitioner with continuity of service from 31.12.97 and grant him all consequential benefits.

Today when the petition is taken up for hearing, the learned counsel appearing for the petitioner submitted that the prayer sought for in this petition has become infructuous, since the petitioner received all the benefits. She also made an endorsement in the Court bundle to that

effect.

Hence, this Writ Petition is dismissed as infructuous. There shall be no order as to cost.
