PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 3 take action against 4th respondent and consider the representation dated 12.04.2021. For Petitioner :

O R D E R

The relief sought for in the present writ petition is to direct the respondents 1 to 3 to take action against the 4th respondent and consider the representation dated 1.04.2021.

2. The representation submitted by the petitioner reveals that there is a blockage in the drainage which has not been properly removed by the authorities competent. Therefore, the petitioner submitted a representation to initiate action by removing the encroachments in front of the 4th respondent. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Special Government Pleader appearing for respondents 1 to 3 based on the instructions received from the Executive Officer, Mangalampettai Town Panchayat made a submission that an inspection was conducted by the Tahsildar, Virudhachalam and the Village Administrative Officer. During the inspection, it was found that the drainage pipes are properly maintained and due to personal vengeance against the 4th respondent, the complaint is filed by the petitioner. On conducting inspection, the authorities found that there is no defect in the drainage system maintained by the authorities and they have submitted the photographs also. If at all there is an allegation of encroachments, then the competent authorities are bound to look into that and initiate appropriate action to remove encroachments. As far as the drainage is concerned, there is no complaint noticed by the authorities and therefore, the relief sought for in the present writ petition deserves no further consideration and accordingly, the Writ Petition stands disposed of. No costs.
