Prayer : - Criminal Original Petition filed under Section 482 of Cr.P.C to call for the records in C.C.No.113/2015 pending on the file of District Munsif cum Judicial Magistrate Court, Uthiramerur and quash the same.

ORDER

(1) The present petition has been filed seeking to quash the further proceedings in C.C.No.113/2015 pending on the file of the District Munsif cum Judicial Magistrate Court, Uthiramerur.

(2) The said Calendar Case came to be filed pursuant to investigation in Crime No.192/2015 dated 13.07.2015 for the alleged offences under Sections 294(b), 341, 323, 506(i) of IPC and also under Section 4 of Tamil Nadu Prohibition of Harassment of Woman Act, 1998.

(3) It is stated by Mr.Saranraj, learned counsel for the petitioner that the petitioner herein had also given a complaint which had resulted in C.C.No.112/2015 being taken cognizance on on the file of the Court of District Munsif cum Judicial Magistrate, at Uthiramerur. https://hcservices.ecourts.gov.in/hcservices/

(4) Mr.E.Raj Thilak, learned Government Advocate [Crl.Side] forwarded a copy of the judgment in the said Calendar Case, viz., CC.No.112/2015, dated 24.02.2016, whereby, after trial, the accused therein had been acquitted of all charges. It would only be appropriate that the trial also proceeds in C.C.No.113/2015.

(5) The present petition is therefore dismissed only on the ground that the counter case in C.C.No.112/2015 had ended in acquittal and therefore, it is only appropriate that C.C.No.113/2015 also goes through the normal process of trial. Let the learned District Munsif cum Judicial Magistrate at Uthiramerur, endeavour to dispose of C.C.No.113/2015 after following due procedure on or before 31.3.2022.

(6) No further orders are required in the present petition. Accordingly, the Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is closed.
