M/s.S.Vadivel, learned counsel for the Appellant and Mr.G.Pragadeeswaran, Administrative Officer of appellant/National Insurance Company are present. LOK ADALAT AWARD The appeal in CMA.No.1791 of 2013 pending on the file of High Court, Madras and preferred against the award passed in M.A.C.T.O.P.No.138 of 2008 on the file of the Motor Vehicle Accident Claims Tribunal, (Principal Subordinate Judge),

Tiruppur, has been referred to Lok Adalat for conciliation today.

2. This is a case of Motor Accident causing injury to the claimant/first respondent herein. The Motor Vehicle Accident Claims Tribunal, (Principal Subordinate Judge), Tiruppur has awarded a sum of Rs.5,22,700/- (Rupees Five Lakhs Twenty Two Thousand and Seven Hundred only) as compensation with interest at 7.5% per annum from the date of filing the claim petition till the date of realisation and also with proportionate costs.

3. Aggrieved by the award of the Motor Vehicle Accident Claims Tribunal, (Principal Subordinate Judge), Tiruppur, the appellant/Insurance Company has preferred this appeal.

4. When the Appeal is taken up today, learned counsel for appellant as well as Administrative Officer of appellant Insurance Company submits that the matter may be dismissed as withdrawn and they also made an endorsement as follows: "Appeal may be dismissed as withdrawn."

5. In view of the endorsement, the Civil Miscellaneous Appeal is dismissed as withdrawn. No order as to costs.
