Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 6th respondent to rescind all the documents Nos.390/2006, 1250/2019, 471/2020 and 2171/2021 in Old Survey No.72/13 or New Survey No.187/1A and its sub-dividends registered by the 8th respondent and for other consequential relief. ORDER
This Writ Petition is filed seeking a Writ of Mandamus directing the 6th respondent to rescind all the documents Nos.390/2006, 1250/2019, 471/2020 and 2171/2021 in Old Survey No.72/13 or New Survey No.187/1A and its sub-dividends registered by the 8th respondent and for other consequential relief.
2. Heard and perused the materials available on record.
3. Mr.R.Vigneshwaran, learned Government Advocate takes notice for 2/5
the respondents 1 to 7. Since no adverse order is to be passed against the 8th respondent, notice to the 8th respondent is dispensed with.
4. It is seen that the issue involved in this case is civil in nature and that right, title and possession are also involved. Therefore, neither the revenue authorities nor the Writ Court can decide the issue. Hence, this Court is not inclined to entertain this writ petition. However, the petitioner is at liberty to work out his remedy before the Civil Court in the manner known to law.
5. With the above observations, the Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 31.01.2024 ksa-2 Index : Yes / No 3/5
