Apprehending arrest in connection with Crime No.787 of 2024 registered for the offences punishable under Sections 4(1)(A) & 4(1-A) of the Tamil Nadu Prohibition (Amendment) Act r/w Section 123 of BNS, the present petition has been filed by the petitioner seeking anticipatory bail.

2. Pleading innocence on the part of the petitioner/A4, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He further submits that this is the third application for anticipatory bail filed by the petitioner. He also submits that the co-accused in this case has already been enlarged on anticipatory bail by this court in Crl.O.P.No.26703 of 2024 dated 25.10.2024. Hence, he prayed for grant of anticipatory bail to the petitioner.

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that the accused were found to be in illegal possession of 270 litres of unauthorized pondicherry liquor. He further submits that this Court, taking into consideration the previous antecedents of the petitioner, had dismissed the petitioner's second bail application, whereas, in respect of the co-accused, who has been granted anticipatory bail by this Court, has only one previous case. He also submits that in the present case, there is no change of circumstances.

4. Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and taking note of the facts that the petitioner is habitual offender, having 21 previous cases and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, the Criminal Original Petition stands dismissed. 07-02-2025 HAM To
