ORDER : The Court Made the following order :- The petitioner, who was arrested on 18.11.2020 and remanded to judicial custody on 22.11.2020 for the alleged offences punishable under Sections 457 & 380 of IPC, in Crime No.754 of 2019, seeks bail.

2. The allegation is that the petitioner trespassed into the de-facto complainant's house and robbed cash of Rs.11,00,000/- and 15 sovereigns of gold jewels. Hence, the complaint. The petitioner was arrested on 18.11.2020 and remanded to judicial custody on 22.11.2020.

3. The learned counsel for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody since 22.11.2020. Hence, he prays for grant of bail.

4. The learned Additional Public Prosecutor would submit that the petitioner is an habitual offender and he is having eight previous cases involved in theft. Hence, she vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the learned Additional Public Prosecutor made a submission that the petitioner is an habitual offender and he is having eight previous cases, this Court is not inclined to grant bail to the petitioner at this stage.

6. Accordingly, this Criminal Original Petition stands dismissed.
