O R D E R

Mr.R.Vigneshwaran, learned Government Advocate accepts notice for respondents. With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed seeking for issuance of a writ of mandamus, directing the first respondent herein to dispose of the appeal dated 09.12.2022 filed by the petitioner within a stipulated period as prescribed by this Court.

3. The learned counsel for the petitioner submitted that aggrieved with the order passed by the second respondent herein dated 10.11.2022, the petitioner has preferred an appeal before the first respondent on 09.12.2022. However, the first respondent has not disposed of the appeal till date, and hence, the present writ petition has been filed.

4. Today when the matter was taken up for hearing, the learned Government Advocate appearing for the respondents submitted that the Pg.Nos.3/6

respondents have already issued summons to the petitioner on 19.01.2024 for enquiry, which is likely to be conducted on 06.02.2024 at 3.00 p.m.

5. Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the petitioner, without expressing any opinion with regard to the merits of the case, this Court directs the petitioner to appear for enquiry on 06.02.2024 at 3.00 p.m and submit her objections if any, and the first respondent is directed to dispose of the appeal on merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as rival claimants/interested parties if any as the case may be within a period of two months from the date of receipt of a copy of this order.

6. With the above direction this Writ Petition is disposed of. There shall be no order as to costs.
