ORDER

Learned counsel for the petitioner would submit that though this Court granted suspension of sentence to the petitioner by order dated 21.11.2025 in Crl.M.P. No. 20251 of 2025 in Crl.A. No. 450 of 2024, the petitioner has not been enlarged on bail since he is unable to comply with the condition at para

No. 7(a) i.e., to produce two sureties for a sum of Rs.25,000/- each. He would submit that the sentence imposed on co-accused was suspended on their executing a bond for Rs.10,000/- with two sureties. Hence, he would request that the said condition may be modified in respect of the petitioner. 2.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.

Since the petitioner is still in custody in spite of the order granting suspension of sentence, the condition imposed by this Court by order dated 21.11.2025 in Crl.M.P. No. 20251 of 2025 in Crl.A. No. 450 of 2024 at para No.7(a) is modified as hereunder:

'7(a) The petitioner/accused is ordered to be released on bail, on his executing a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, in which one surety must be a blood surety, each for a likesum to the satisfaction of the learned Special Judge II, Addl. Special Court for Exclusive Trial of cases under NDPS Act, Chennai.'
