The petitioner has filed this writ petition under Article 226 of the Constitution of India praying to issue a Writ of Mandamus forbearing the respondents from convening the Board of Directors Meeting for the 2nd respondent society to be held on 21.03.2016.
2. According to the learned counsel for the petitioner, the petitioner has challenged the impugned notice dated 14.03.2016 to convene the Meeting for the Board of Directors. At the time of admission, this Court granted interim injunction by an order https://hcservices.ecourts.gov.in/hcservices/
dated 18.03.2016, in the light of interim order passed by this Court in W.P.No.2034 of 2016 dated 21.01.2016.
3. Today, when the matter is posted for hearing, both the learned counsel appearing for the parties submitted that W.P.No.2034 of 2016 was dismissed by this Court on 05.04.2017.
4. The present writ petition is filed by the petitioner to forbear the respondents from convening the Board of Directors Meeting for the 2nd respondent society on 21.03.2016. According to the learned counsel for the 2nd respondent the interim order was granted by this Court on 18.03.2016 for the meeting to be convened on 21.03.2016, and since already one year has lapsed, the relief sought for in the present writ petition has become infructuous.
5. In the light of the submission made by the learned counsel for the 2nd respondent society that the prayer sought for in the writ petition has become infructuous, the present writ petition may be dismissed as infructuous.
6. Accordingly, this writ petition is dismissed as infrutuous.
No costs. Consequently, connected Writ Miscellaneous Petition is closed.
