C.M.P.No.1186 of 2024 in S.A.No.184 of 2018 P.B.BALAJI, J.

This Civil Miscellaneous Petition has been filed to bring on record the appellants 5 & 6 as LRs of the deceased 1st appellant.

2. I have gone through the affidavit filed in support of this application and the cause of action survives the death of the 1st appellant. Though, it is stated that the 1st appellant died on 11.05.2019, there is no abatement since, the 2nd appellant is already on record.

3. Further, the Learned Counsel for the appellant states that 1st respondent also passed away on 15.04.2020 and his legal representatives are the respondents 2 to 6 who are already on record in the above Second Appeal. Hence, the factum of death of the 1st respondent is recorded.

4. The Learned Counsel for the respondents 1 to 6 have no serious objection for allowing this application. Hence, this Civil Miscellaneous Petition is ordered.

5. In the meanwhile, the Learned Counsel for the appellant also brings to my notice that the address of the respondent in the system is reflecting incorrect address and Registry shall look into the same and effect necessary correction if any.
