ORDER

This Criminal Original Petition has been filed to withdraw and transfer the investigation with respect to Crime No.28 of 2013 from the file of the 3rd respondent to the file of the 2nd respondent.

2.No representation for the petitioner either in person or by his counsel.

3.The learned Government Advocate appearing for the respondents submitted that on completion of investigation, the 3rd respondent reporting that the case has been "Further Action Dropped" and no further action needs to be taken and the final report to that effect has been filed before the learned Judicial Magistrate No.III, Thirupathur. Thereafter, a notice has been served to the petitioner in R.C.S.No.04 of 2013, dated 27.07.2013.

4.In view of the same, there is no necessity to transfer the case as prayed for by the learned counsel for the petitioner. Hence, nothing survives for adjudication in the above case and this Criminal Original Petition is dismissed.
