Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents herein to forthwith consider the representation of the petitioner dated 16.09.2015 and treat the period from 18.06.2013 to 06.09.2015 (819 days) as the period "in service" by the petitioner and pay salary and other 1/4

O R D E R

The relief sought for in the present writ petition is to direct the respondents to consider the representation submitted by the writ petitioner on 16.09.2015 and regularise the intervening period as the petitioner was not allowed to join duty.

2. The learned counsel for the petitioner states that despite the fact that an order of stay was granted by this Court in WP No.16325 of 2013, the petitioner was not allowed to join duty. Thus, the petitioner submitted representation to regularise the said period as duty with full salary and the said representation is yet to be considered.

3. The period of absence is to be regularised in accordance with the Rules in force. The manner in which the period is to be regulated is to be 2/4

decided by the Competent Authorities with reference to the Rules and considering the eligibility of the petitioner. Thus the respondents are directed to consider the representation and pass appropriate orders regarding the regularisation of the period of services in accordance with the rules as expeditiously as possible.

4. With the abovesaid directions, the writ petition stands disposed of. However, there shall be no order as to costs. 09-11-2022 Index : Yes/No.
