ORDER

The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 318(4), 319(2) of BNS, 2023 r/w Section 15(3) of Indian Medical Council Act 1956, in Crime No.5 of 2026 seeks anticipatory bail.

The case of the prosecution is that on 03.01.2026, based on an information received from a decoy, the Joint Director (Medical) and Rural Health Service Department conducted a raid in petitioner's house located at Sivarajpettai and found that the petitioner herein without any qualification or appropriate knowledge in Allopathy medicine had been practising the same; that further during the raid, the petitioner fled away from the spot. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has not given any Allopathy treatment to any persons and he has been falsely implicated in this case; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and that the investigation of this case is pending. 5.

I have considered the submissions made on both sides and perused the materials available on record:

Considering the facts and circumstances of this case, gravity of

offence, the petitioner herein is alleged to be a quack and he ran away from the clinic while the Joint Director (Medical) and Rural Health Service Department conducted inspection, taking note of the fact that the investigation of this case is pending and if the petitioner is granted anticipatory bail, he would indulge in similar offence and it would hamper the investigation process, hence this Court is not inclined to grant anticipatory bail to the petitioner. 7.
