Petition filed under Article 226 of The Constitution of India praying for the issuance of a writ of mandamus directing the respondents 1, 2, 3 and 5 to take necessary action against 4th and 6th to 10th respondents in respect of fraudulent release deed registered before the 4th respondent by the 6th to 10th respondents in Document No.3975 of 2025 dated 26.04.2025 for the land comprised in Survey No.49/1A, Sethukarai Village, Kudiyatham Taluk Vellore District forthwith by considering the petitioner's representation cum complaint dated on 08.12.2025. ORDER
The petitioner asserts that release deed was executed fraudulently by and between respondents 6 to 10 on 26.04.2025 bearing Document No.3975 of 2025. Therefore, after lodging complaint dated 08.12.2025, the present writ petition has been filed.
2. Learned counsel for the petitioner refers to the communication from the Sub Registrar to the police officials 2/5
regarding the error in Document No.671 of 1998. Therefore, he submits that the Sub Registrar should be restrained from registering any conveyances on the basis of the release deed and that an enquiry should be conducted in respect of the fraudulent release deed.
3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for respondents 1, 2 and 4 and Mr.S.Sugendran, learned Additional Public Prosecutor, accepts notice for respondents 3 and 5.
4. Mr.Baranidharan submits that the registering officer does not have the power to cancel the release deed dated 26.04.2025. As regards the lodging of the first information report and proceedings pursuant thereto, he submits that the matter is in the hands of the police.
5. On perusal of the affidavit in support of this writ petition, it appears that the petitioner relies on partition deed dated 14.11.1990. It also appears that the petitioner is complaining about the execution of release deed on 26.04.2025 in spite of the fact that the relevant property was conveyed in favour of the petitioner in the year 1998. In effect, there is title dispute between the petitioner 3/5
and respondents 6 to 10. The appropriate forum for the adjudication thereof is the jurisdictional Civil Court. If any criminality is involved, the police authorities will initiate appropriate proceedings, including pursuant to the communication dated 06.11.2025 from the Sub Registrar.
6. With the above observations, this writ petition is disposed of without any order as to costs.
