This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.M.Ramesh Babu, learned counsel for petitioner and Mr.C.S.Dhanasekaran, learned counsel for the respondent are present before this Court.
TERMS OF SETTLEMENT Both the petitioner and the respondent have agreed to settle the matter with the following terms:-
1. The petitioner is agreed to pay a total sum of Rs.2,80,000/- (Rupees Two Lakhs
and Eighty Thousand only) in three instalments.
2. The petitioner is agreed to pay the first instalment of Rs.1,00,000/- (Rupees one lakh only) on 14.11.2023.
3. The petitioner is agreed to pay the 2nd instalment of Rs.1,00,000/- (Rupees one lakh only) on 14.12.2023.
4. The petitioner is agreed to pay the 3rd and final instalment of Rs.80,000/- (Rupees one lakh only) on 14.01.2024.
2. In view of the above settlement, the parties are agreed to compound the offence.
3. Accordingly, this Criminal Revision is disposed of as settled. The judgement of conviction and sentence passed by the Court below is set aside and the petitioner/accused is acquitted from the charges punishable under Section 138 of NI Act. In view of the settlement arrived at between the parties, offence is compounded under Section 147 of Negotiable Instruments Act. This Lok Adalat award is passed in terms of the above settlement.
