J U D G M E N T

The learned counsel for the appellant made a submission that the dispute between the parties to the present Appeal Suit had already been settled out of Court. The learned counsel for the appellant also made an endorsement to the said effect. Thus, no further adjudication needs to be entertained in respect of the grounds raised in the present Appeal Suit.

2. In view of the submissions and the endorsement made by the learned counsel for the appellant, the present Appeal Suit stands dismissed as withdrawn. However, there shall be no order as to costs. The connected miscellaneous petition is also dismissed. The Registry is directed to refund the Court Fee in favour of the appellant as per the rules in force. 22-02-2023 Speaking Order/Non-Speaking Order.
