2. Mr.P.Parthikannan, learned counsel, takes notice for first respondent.
3. Notice to second respondent is dispensed with since the second respondent remained ex parte before the Tribunal.
4. Heard the learned counsel on either side and perused the records.
5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 41 days in filing the above appeal is condoned.
Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission along with C.M.A.No.2593 of 2022. Registry is directed to print the name of Mr.P.Parthikannan, learned counsel for first respondent in the cause list at the time of admission.
