Respondents Prayer: Original Petition filed under Section 372 of Indian Succession Act, 1925, read with under Order XXV Rule 6 of Original Side Rules to grant Succession Certificate to the petitioner with power to collect the securities and to receive the interest the dividends on and negotiate and transfer the securities specified in the schedule herein. ORDER

In the above matter, both the parties have filed a Joint Memorandum of Compromise stating that the parties have settled their disputes between them. The terms of the Settlement have also been set out in the Joint Memorandum of Compromise are as follows:

"The respondent herein shall not have any objection for granting Succession Certificate in the name of the petitioner.

The petitioner undertakes to hand over 500 Share Certificates to the 1st respondent with duly signed transfer form in her favour. The 1st respondent is at liberty to transfer 500 Share Certificates in her name or sell it to some third party as desired by her.

The petitioner herein undertakes to hand over 500 Share Certificates to the 2nd respondent with duly signed transfer form in her favour. The 2nd respondent is at liberty to transfer 500 Share Certificates in her name or sell it to some third party as desired by her.

The petitioner herein undertakes to hand over 500 Share Certificates to the respondents 3 to 5 with duly signed transfer form in their favour. The respondents 3 to 5 are at liberty to transfer 500 Share Certificates in their name or sell 2/4

it to some third party as desired by them."
