ORDER

This Criminal Original Petition has been filed by the petitioners/A.1 to A.5 seeking to quash the proceedings in Crime No.10/2015, pending on the file of the first respondent police.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the first respondent as well as the learned counsel appearing for the second respondent/de facto complainant.

Learned Additional Public Prosecutor submits that upon conclusion of the investigation, charge sheet has been filed before the learned Judicial Magistrate No.1, Pollachi, and the same has also been taken on file as C.C.No.162 of 2016 for the offences under Sections 498(A), 406, 494, 505(ii) and 109 IPC. It is further submitted that some of the witnesses have been examined and trial is in progress.

In view of the above, nothing survives for adjudication in this petition and accordingly, recording the said submission, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petition is also dismissed.
