ORDER

This Criminal revision petition has been filed to call for the records in Crl.M.P.No.4903 of 2017 on the file of the Judicial Magistrate Court, No.I, Puducherry and set aside the same and allow this revision petition considering the facts and circumstances of the case.

2. The learned public prosecutor, puducherry submits that there is an order of bail passed in Crl.MP.No.264 of 2018.

3. Under provision 85(3) of Cr.P.C the petitioner is entitled to file a petition for release of the attached property, if he satisfies the trial court.

4. Considering the pendency of Crl.MP.No.4282 of 2017, the learned Judicial Magistrate No.I, Puducherry is directed to pass appropriate orders in the manner known to law.

5. At this juncture, the learned counsel for the petitioner seeks permission of this court to withdraw this revision petition with liberty to move an application before the trial court and he has also made an endorsement to that effect. Hence the Criminal revision petition is dismissed with liberty as sought for. Consequently, connected miscellaneous petition is closed.
